ATO Audits and Dispute Management

Nuwaru has worked alongside clients throughout the ATO’s risk reviews and justified trust programs, which include the Top 100, Top 1,000, Next 500, and Top 5,000 programs.  We know what the ATO typically asks.

Our goal is to have all our clients continuously “ATO ready”.  To do this we offer our Tax Risk Review service, so we have already worked with you to have a response and documents ready for the ATO’s initial request for information (“RFI”), and to have addressed any risk items appropriately.

Where we do have the opportunity to work with you before the ATO calls, we can work with you to conduct a fast-tracked risk review in conjunction with working with you to put together the documents and responses to the ATO’s anticipated or actual RFI. This enables you to respond to the ATO within the tight time frames given, and proactively address any issues identified in the process.

In both scenarios, we help manage your dealings with and responses to the ATO in order to achieve the best outcome for you.

Should a review end in a dispute with the ATO, with our experience we will help manage the optimal resolution of the dispute for you.

Fast-tracked risk review

Where we have not already had the opportunity to conduct a Tax Risk Review and get you ATO ready we conduct a fast tracked risk review in order to identify and manage income tax and GST issues prior to the ATO commencing its review/audit.

This work includes working with you to compile preliminary responses and gather the necessary documentation to enable you to promptly respond to the ATO initial RFI.

Issue analysis and risk assessment

We review and risk assess identified issues that arise either as a result of a fast-tracked review or from ATO enquiries, and recommend next actions.

Issues management and risk mitigation

We agree with you a risk management and mitigation plan, and implement the agreed strategies. This can include:

  • Preparation of position papers
  • Preparation of voluntary disclosures
  • Preparation of ruling requests

Responding to the ATO

We manage or assist in the compiling and review of responses to ATO information requests through to completion of the ATO review or audit.

ATO engagement

We manage follow up requests for information and questions raised on issues identified by the ATO.

Should a significant issue arise, we manage the ATO engagement for you, which can include:

  • Drafting response
  • Review ATO position papers
  • Drafting client position papers
  • Briefing counsel

Whilst our approach is always to avoid a dispute with the ATO, unfortunately this is not always possible.

Where a dispute does arise, Nuwaru can call on deep experience successfully managing ATO disputes. This can include:

  • Issue assessment and advising on resolution strategies

  • Leading negotiated settlement processes
  • Facilitating and attending mediation processes
  • Preparation of objections to assessment
